DMCA / Copyright Policy

Hamilton Consulting LLC("we," "us," or "our") respects the intellectual property rights of others and expects users of Edura (https://www.getedura.com) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and applicable law.

1. DMCA Safe Harbor

Edura is a platform that hosts user-generated content, including comments, reviews, blog posts, and listing submissions. As a service provider under the DMCA, we qualify for safe harbor protection under 17 U.S.C. § 512. We do not monitor all user-submitted content but will act promptly upon receiving a valid takedown notice.

2. Filing a Takedown Notice

If you believe that content on Edura infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)
  3. Identification of the material claimed to be infringing, including the URL or other specific location on the platform where it appears, with enough detail for us to locate it
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

3. Designated Agent

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the Commonwealth of Virginia and that you will accept service of process from the person who provided the original takedown notice (or their agent)

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

5. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are repeat infringers of copyright. We will terminate accounts in appropriate circumstances, including when a user has been the subject of three or more valid takedown notices.

6. Good Faith Requirement

Filing a DMCA notice or counter-notification carries legal consequences. Before submitting a notice, carefully consider whether the use of the material constitutes fair use or is otherwise lawful. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.

7. Modifications

We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated "Last updated" date.
